Abstract

In the case of children who are in conflict with the law, there are exceptions in handling these children's cases, namely diversion efforts as a form of implementing restorative justice. Diversion is one of the efforts made and to mediate cases based on justice as in a decision there are at least three principles, namely expediency, fairness and legal certainty. Of course there are significant differences between adults and minors when it comes to the realm of criminal law, because prison is not a relevant solution to apply to children who commit criminal acts. The research method used by the author is a qualitative method with direct field observation techniques by interviewing judges who handle diversion cases and studying existing cases as primary data sources. As for supporting data, the author uses book references and previous research journals. From this research, the author found that there were several cases of children who were in conflict with the law in the Tanjungpandan district court using diversion efforts in their resolution. So the author can draw the conclusion that diversion is a highly recommended alternative in resolving cases of children in conflict with the law
